Big Berkey is the brand's most popular model and the configuration people picture by default. As shipped (a 2.25-gal stainless canister plus two Black Berkey elements), it holds no third-party NSF, IAPMO, or WQA certifications on either component. The brand publishes its own ISO 17025 lab reports tested against NSF/ANSI 42/53 protocols, but those are not the same as a listing from an accredited certifier (NSF, WQA, or IAPMO). Independent assessment from Tap Score notes the published lab tests ran only 200 gallons, about 3% of the 6,000-gallon volume Standard 53 requires before the effluent is tested. Buyers searching NSF's certification database for 'Berkey' or 'New Millennium' will find no listings as of 2026-05-23.

Royal Berkey is the larger-family format (3.25-gal canister, designed for 2-4 person households) built around the same Black Berkey element. Its certification footprint is identical to the Big Berkey: no NSF/ANSI 42/53 health-contaminant certifications. A bigger canister does not add any certification. The Royal Berkey product page implies the same 200+ contaminant scope as the smaller systems, which is fair as a sister-model description but carries the same gap between the brand's own lab reports and genuine third-party certification.

Travel Berkey is the brand's smallest canister (1.5 gal) and its travel, emergency, and survival-kit option. It's marketed heavily to prepper, camping, and off-grid buyers, for whom the format itself (no electricity, dishwasher-safe stainless steel, packs into a survival bag) often matters more than certification. At the element level it is the same as every other Berkey model: the NSF/ANSI 42 listing covers chlorine and taste-and-odour via the Phoenix Gravity element, and no certifier lists the Black Berkey element for health contaminants. If you're choosing Berkey because you expect certified contaminant reduction during emergency use of unknown source water (surface water, or well water with an unknown lead or arsenic profile), the brand's own lab reports are not the third-party certification that 'NSF certified' marketing usually implies.

Berkey is the textbook 'lab-tested, not certified' brand — and it's also under an active EPA stop-sale order. It's a popular US gravity-fed filter, designed and distributed by New Millennium Concepts, Ltd. (NMCL) of Arlington, Texas, pairing a stainless-steel canister (Travel/Big/Royal/Imperial/Crown sizes) with the proprietary Black Berkey carbon-block element NMCL has made since 2003.

The brand holds no NSF, IAPMO, or WQA health-contaminant certification on the Black Berkey element. What it does hold is narrower than the marketing implies: NSF lists Big Berkey, Royal Berkey and Travel Berkey under the manufacturer of record, New Millennium Concepts Ltd, for NSF/ANSI 42 — chlorine and taste-and-odour reduction — via the Phoenix Gravity element, not the Black Berkey one. Its substitute proof is brand-published ISO 17025 lab reports (CVR Labs and RAYNU Analytical Labs in India) tested against NSF/ANSI 42/53 — but tested to a standard is not the same as certified to it by an independent certifier.

On top of that, the brand has been under EPA FIFRA enforcement since December 2022; an active Stop-Sale order (SSURO) against affiliate Berkey International has halted standalone Black Berkey replacements.     EPA issued SSURO Docket FIFRA-08-2023-0038 against Berkey International (an NMCL affiliate), alleging the company sold Black Berkey Filter Products that EPA classified as unregistered, misbranded pesticide devices. This SSURO is the central legal artifact of the EPA enforcement timeline.

    NMCL filed suit against the EPA (Case 4:23-cv-826, Northern District of Texas) seeking an injunction lifting the SSURO and challenging the EPA's pesticide-device reclassification of the Black Berkey element.

    District Court dismissed NMCL's complaint for lack of standing; NMCL filed an appeal with the Fifth Circuit Court of Appeals.

NMCL is based in Arlington, Texas, where Black Berkey elements have historically been made. After the 2022-2023 EPA enforcement, NMCL moved the new Phoenix element to an unnamed partner facility in India — described in the brand datasheet as WQA Gold Seal certified at the facility level.

Phoenix testing was done by CVR Labs and RAYNU Analytical Labs (both NABL-accredited, ISO/IEC 17025:2017, also in India). NMCL does not publish a component country-of-origin manifest for the canister steel or valves. The Black Berkey element holds no third-party certifier listing under any name on the NSF directory as of 2026-05-23.

About Berkey Marketing Language

Some claims on Berkey packaging and product pages are frequently confused with what the underlying third-party certifications actually cover. The note below documents one such mismatch with primary-source citations so you can verify the specifics yourself.

Berkey markets the Black Berkey against NSF/ANSI 42/53 protocols, but it holds no third-party NSF, IAPMO, or WQA certification and has been under active EPA enforcement since 2022.

Bottom line: tested to a standard and certified to it are not the same — and Berkey has neither a listing nor a clean regulatory record. Three things converge here:

  • No NSF/ANSI 53 listing despite health claims. NSF lists Big, Royal and Travel Berkey under New Millennium Concepts Ltd (read 2026-09-15), but only for NSF/ANSI 42 — chlorine and taste and odour, via the Phoenix Gravity element. Nothing at 53, which is the standard the lead, arsenic and fluoride claims would need.
  • Lab reports stand in for certification. The brand's proof is its own ISO 17025 lab reports — for the 2025 Phoenix element, run by CVR Labs and RAYNU Analytical Labs in India (NABL-accredited, ISO/IEC 17025:2017). Tested by a lab is real evidence, but not a listing by an accredited certifier (NSF, WQA, IAPMO). Tap Score found Berkey's tests ran only ~200 gallons — about 3% of the 6,000 NSF/ANSI 53 requires.
  • Active EPA enforcement. Since December 27, 2022 the EPA issued a Stop-Sale order (SSURO) against reseller JEI over the silver content in the Black Berkey element; on May 8, 2023 it issued SSURO Docket FIFRA-08-2023-0038 against affiliate Berkey International. NMCL sued (Northern District of Texas, Case 4:23-cv-826, August 2023); the court dismissed for lack of standing in November 2023 and the Fifth Circuit appeal is pending. A parallel case (Berkey International v. EPA, Case 3:24-cv-01106, Puerto Rico, filed March 6, 2024) reached First Circuit oral argument October 27, 2025. Both pending as of 2026-05-23.

What to watch: standalone Black Berkey replacements have not been sold since the SSURO. The Phoenix element's NSF/ANSI 42 listing is live as of 2026-09-15 — and 42 covers chlorine taste/odour, not the lead, arsenic, fluoride, PFAS and microplastics claims that drive most Berkey purchases. So 'is Berkey NSF certified?' is now genuinely yes-but: yes at 42 on the Phoenix element, no at every health-contaminant standard, and nothing at all on the Black Berkey element itself. For certified gravity that solves both gaps, Doulton/British Berkefeld and ProOne G3.0 are drop-in compatible.
